PERSONAL DATA PROTECTION POLICY
I. General Information on the Law on the Protection of Personal Data No. 6698
The Law on the Protection of Personal Data No. 6698 ("KVKK"/"Law") was published in the Official Gazette No. 29677 on April 7, 2016. The purpose of the Law is to protect the fundamental rights and freedoms of individuals, particularly the right to privacy, in the processing of personal data and to establish the obligations of natural and legal persons who process personal data, as well as the procedures and principles they must adhere to.
The provisions of the KVKK apply to natural persons whose personal data are processed and to natural or legal persons who process such data wholly or partially by automated means or, provided that it is part of any data recording system, by non-automated means. For the purposes of this Law:
- Explicit consent: The freely given, specific, informed, and unambiguous consent of the data subject regarding a particular matter.
- Anonymization: The process by which personal data is rendered incapable of being associated with an identified or identifiable natural person, even when combined with other data.
- President: The President of the Personal Data Protection Authority.
- Data subject: The natural person whose personal data is processed.
- Personal data: Any information relating to an identified or identifiable natural person.
- Processing of personal data: Any operation performed on personal data, wholly or partially by automated means or by non-automated means provided that it is part of a data recording system, such as collection, recording, storage, preservation, alteration, rearrangement, disclosure, transfer, acquisition, retrieval, classification, or prevention of its use.
- Board: The Personal Data Protection Board.
- Authority: The Personal Data Protection Authority.
- Data processor: A natural or legal person who processes personal data on behalf of the data controller based on the authority granted by the data controller.
- Data recording system: A recording system in which personal data is structured according to specific criteria.
- Data controller: A natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
As Weekend Tekstil Kozmetik İmalat Sanayi ve Ticaret Limited Şirketi ("Sign of Weekend" or "Company"), we place great importance on the secure storage of your personal data. Therefore, we take the utmost care to ensure that your personal data is processed and stored in the best possible manner. Being fully aware of our responsibilities, we process your personal data within the framework specified below in accordance with the Law on the Protection of Personal Data No. 6698 ("Law") and relevant legislation. The Personal Data Protection Policy has entered into force as of the date it was published on the Sign of Weekend website.
II. Identity of the Data Controller
Your personal data is processed by Weekend Tekstil Kozmetik İmalat Sanayi ve Ticaret Limited Şirketi (hereinafter referred to as "Sign of Weekend" or the "Company"), located at "Karacaoğlan Mahallesi 6166 Sok. No:32/1 Kat:2 D:22 Bornova-İzmir," in its capacity as the Data Controller under the Law. Your personal data is processed lawfully, in good faith, and in a manner that is specific, explicit, and legitimate, limited to the purposes and legal grounds stated in this disclosure text. As the Company, we declare that we will act in compliance with the Law in our capacity as the Data Controller. You may access our corporate information exclusively through our official website at www.signofweekend.com. To avoid fraud, we emphasize that the Company does not have any other websites apart from [www.signofweekend.com].
III. Collection and Processing of Personal Data
Your personal data is collected and processed in accordance with Articles 5 and 6 of the Law on the Protection of Personal Data No. 6698 (KVKK), solely for the purpose of fulfilling the contractual relationship established with you. It is processed within the legal framework to conduct all activities of the Company, ensuring that our legal and contractual obligations are fully and properly met. Accordingly, your personal data will be processed within the scope of our legitimate interests, provided that it is directly related to the establishment and/or performance of a contract, necessary for the fulfillment of a legal obligation, or essential for the establishment, exercise, or protection of a right, without harming your fundamental rights and freedoms.
To ensure the security and confidentiality of your personal data, the Company has taken all necessary technical and administrative measures at the highest level. Our Company does not process sensitive personal data. The personal data processed by Sign of Weekend for the purposes specified below is obtained directly from you through the following methods: during your visit to our website and mobile application, within the framework of the membership relationship established with you, through forms and surveys you complete, during calls made through our call center, via emails sent to the Company's email address, or through messages sent via any communication channel, including our customer contact line and social media accounts. Additionally, personal data may be collected during product purchases through the website and mobile application or through the establishment of other legal relationships, whether orally, in writing, visually, or electronically.
The main personal data collected and processed by Sign of Weekend through the methods mentioned above include:
- Identity information (your name, surname, Turkish ID number, or if you are not a Turkish citizen, your passport number or temporary Turkish ID number)
- Tax identification number
- Address
- Phone number
- Email address
- Date of birth (if provided through customer forms or surveys)
- Customer transaction, request, and complaint data (if communicated via the Company's communication channels)
- Financial information required for our business processes
- Legal transaction data
- Transaction security data used for information security processes
Sign of Weekend reserves the right to make changes to this Personal Data Protection Policy at any time. Any changes made will take effect immediately upon publication of the updated policy. By accepting this agreement, the Member or Customer acknowledges that they have read and understood all the terms of Sign of Weekend’s Personal Data Protection Policy (KVKK Policy) and officially declare their acceptance.
IV. Purposes of Processing Personal Data and Explicit Consent
The processing of your personal data for purposes such as campaigns, promotions, birthday or special day celebrations, advertisements, promotions, and marketing activities, including the sending of SMS and/or emails, is subject to your explicit consent in accordance with Article 5/1 of KVKK. You may withdraw your explicit consent at any time. If you withdraw your consent, your personal data will no longer be used for campaign, birthday or special day celebrations, promotions, advertisements, and marketing activities, nor for contacting you regarding such matters.
V. Transfer of Personal Data
Sign of Weekend takes all necessary measures to maintain and protect confidentiality, prevent unauthorized use, and restrict access to personal data by third parties. The Company strictly upholds its responsibility to protect collected data and ensures that such data is used solely for the purposes specified within the scope of Law No. 6698 on the Protection of Personal Data ("KVKK").
Personal data is not transferred abroad. The transfer of personal data within Turkey is limited to cases where it is necessary for the establishment and/or performance of a contract pursuant to Article 8/2(a) of the KVKK, for compliance with legal obligations under Article 5/2(ç), and for the establishment, exercise, or protection of a legal right under Article 5/2(e). In accordance with the provisions of the KVKK and related legislation, personal data may be shared, provided that adequate and effective protective measures are implemented in compliance with legal security and confidentiality principles. Accordingly, personal data may be shared with public institutions and organizations authorized by law to request such data, domestic institutions with which we have contractual relations, suppliers, business partners, third-party service providers, affiliated logistics and cargo companies, legal advisors, accountants, and consultants, as well as competent authorities, all within the scope and limitations outlined in Articles 8 and 9 of the KVKK.
However, if official authorities duly request user or customer information and such disclosure is required under applicable mandatory legal provisions, the requested information may be shared with the relevant authorities. VI. Your Rights Regarding the Protection of Personal Data
Pursuant to Article 11 of the KVKK, you may exercise the following rights at any time by contacting our Company, which acts as the Data Controller:
- Inquire whether your personal data has been processed and, if so, request details;
- Request information regarding the processing of your personal data;
- Learn the purpose of personal data processing and whether they are used in accordance with that purpose;
- Identify the third parties to whom your personal data has been transferred, domestically or abroad;
- Request correction of your personal data if it has been processed incompletely or inaccurately;
- Request deletion or destruction of your personal data under the conditions set forth in Article 7 of the KVKK;
- Request notification of the actions taken under (d) and (e) above to third parties to whom your personal data has been transferred;
- Object to any negative consequences arising from the exclusive analysis of processed data by automated systems;
- Demand compensation for damages incurred due to the unlawful processing of your personal data.
To exercise your rights under the KVKK, you may complete the "Application Form for the Protection of Personal Data," available here, and submit it in person to the address "Karacaoğlan Mahallesi 6166 Sokak No:32/1 Daire:22, Bornova-İZMİR," send it via notary or registered mail, or email it to info@signofweekend.com.
Sign of Weekend will process your requests as promptly as possible and no later than thirty days, depending on the nature of the request. You may contact our Customer Satisfaction Unit at info@signofweekend.com at any time for any inquiries regarding your personal data.
VII. Retention and Disposal of Personal Data
Personal data, even if lawfully processed in compliance with the KVKK and other applicable laws, will be deleted, destroyed, or anonymized either upon request or when the reasons for processing no longer exist.
Personal data processed for the establishment of a contract and the fulfillment of the Company's legal or contractual obligations will be disposed of after the purpose of processing ceases, subject to the retention periods specified in the law.
